TERMS AND CONDITIONS OF USE OF THE MINI SITE

ARTICLE 1. DEFINITIONS

For a proper understanding of these Terms and Conditions of Use, Users shall refer to the following definitions:

  • ARTE GEIE : stands for the Groupement Européen d’Intérêt Économique (European Economic Interest Grouping) registered with the Strasbourg Trade and Companies Register under number C 382 865 624, with its registered office at 4 Quai du Chanoine Winterer, 67000 Strasbourg (France).
  • T&Cs : means these Terms and Conditions of Use.
  • ARTE Platform Terms and Conditions of Use: means the general terms and conditions of use applicable to the ARTE Platform, published by ARTE GEIE, accessible at the following URL: https://www.arte.tv/sites/corporate/en/general-conditions-of-use/ (or any other address that may replace it). These govern, among other things, the creation, management and deletion of MyARTE Accounts, as well as the use of the electronic services provided by ARTE GEIE, including via the ARTE Platform.
  • MyARTE Account : means the personal account allowing users of the ARTE Platform to access the content and services offered by ARTE GEIE, as well as various related features, including the ability to vote on the Mini Site as part of the ArteKino Festival 2025.
  • ArteKino Festival 2025 : means the online European film festival entitled “ArteKino Festival”, accessible from the Mini Site and organised from 1 December 2025 to 31 December 2025, allowing Users to watch and vote for one or more films from the proposed selection, by awarding them between one and five stars, in accordance with the terms and conditions defined in these T&Cs.
  • Mini Site : means the website dedicated to the ArteKino Festival 2025, accessible via the following URL: https://artekinofestival.arte.tv/ (or any address that may replace it).
  • ARTE Platform : means the online platform published by ARTE GEIE and accessible via the following URL: https://www.arte.tv.
  • User : means any natural person accessing the Mini Site, whether or not they have a MyARTE Account, who may view all or part of the content offered and/or vote for one or more films included in the ArteKino Festival 2025 selection, in accordance with the conditions and procedures set out in these T&Cs.

ARTICLE 2. PURPOSE AND SCOPE

The purpose of these T&Cs is to define the conditions under which Users may access and use the Mini Site.
Access to and use of the Mini Site imply full and unconditional acceptance of these T&Cs.
The applicable version of the T&Cs is that in effect at the time of each access to and/or use of the Mini Site by the User.
The User acknowledges and accepts that the ARTE Platform Terms and Conditions of Use, as defined in Article 1 of this document, apply to all matters relating to MyARTE Accounts, including their creation, management and deletion, as well as the protection of minors.
In all other respects, in the event of any contradiction, these T&Cs shall prevail over the ARTE Platform Terms and Conditions of Use, particularly regarding access to and/or use of the Mini Site.
Each provision of these T&Cs is valid separately and remains valid and enforceable independently of the others. The invalidity of one clause or part of these T&Cs shall not affect the validity of the remaining clauses.

ARTICLE 3. CONDITIONS OF ACCESS TO THE MINI SITE AND PARTICIPATION IN VOTING

The Mini Site is freely accessible online to any natural person with internet access, it being understood that internet connection costs are borne by the User.
However, participation in voting as part of the ArteKino Festival 2025 is strictly reserved for Users logged into their MyARTE Account. To this end, the User must log in to their existing account or create a new one, then connect via the link provided for this purpose to vote for one or more films from the ArteKino Festival 2025 selection on the Mini Site.
The Mini Site is, in principle, accessible from all European territories. However, access to all or part of the films in the ArteKino Festival 2025 selection may be restricted or disabled in territories not covered by ARTE GEIE’s broadcasting rights.
Minors may access the Mini Site and vote as part of the ArteKino Festival 2025 under the responsibility of their legal guardian, who undertakes to ensure compliance with these T&Cs.
Users are informed that some audiovisual content in the ArteKino Festival 2025 selection may be subject to age restrictions. In this respect, and in accordance with the ARTE Platform Terms and Conditions (to which express reference is made here), access to and voting for such content are conditional upon:
(i) logging in to or creating a MyARTE Account, and
(ii) prior age verification through that account.
In any event, it is expressly stated that the Mini Site may contain content not suitable for minors. Therefore, persons with parental authority are responsible for supervising minors’ use of the Mini Site.
Participation is strictly personal and limited to one vote per User per film in the ArteKino Festival 2025 selection.
ARTE GEIE reserves the right to modify, suspend, or terminate access to the Mini Site and/or the voting process for the ArteKino Festival 2025 at any time and without prior notice, particularly for technical, security, maintenance, update, or legal compliance reasons.

ARTICLE 4. VOTING PROCEDURES

Voting for the ArteKino Festival 2025 takes place exclusively on the Mini Site. Only Users logged into their MyARTE Account may vote for one or more films from the festival’s selection.
Each User may assign a rating from one to five stars to one or more films in the selection by clicking on the “Vote” button located beneath the corresponding film.
Users may change their vote until the voting period closes by revisiting the film’s page and selecting a new number of stars. After this deadline, no vote changes will be taken into account.
Votes are recorded in real time and counted at the end of the voting period, subject to compliance with these T&Cs and any additional rules that may be specified on the Mini Site.
ARTE GEIE reserves the right to verify the validity of votes and to exclude any vote that appears suspicious or non-compliant with these T&Cs, particularly those submitted fraudulently, repeatedly, automatically, abnormally, or contrary to the spirit and fairness of the ArteKino Festival 2025.
ARTE GEIE cannot be held responsible for any lost, delayed, altered, or uncounted votes, especially when resulting from connection problems, technical failures, handling errors, or, more generally, from any cause beyond its control.

ARTICLE 5. USE OF THE MINI SITE

The User undertakes to use the Mini Site fairly and for its intended purpose, in compliance with these T&Cs and applicable laws and regulations.
In particular, the User shall refrain from:

  • Using the Mini Site for fraudulent, abusive, or improper purposes, or for any purpose contrary to its intended use;
  • Interfering with or attempting to interfere with the proper functioning of the Mini Site, including through automated programs or technical devices intended to multiply votes and/or bypass security systems;
  • Accessing or attempting to access unauthorised data or areas;
  • Extracting, reproducing, reusing, distributing, or exploiting, by any means whatsoever, all or part of the Mini Site and/or its accessible content without ARTE GEIE’s prior, specific, written authorisation;
  • Using the Mini Site in a way that could cause overload, disruption, and/or excessive consumption of available technical resources;
  • More generally, infringing upon the rights of ARTE GEIE, its partners, and/or third parties.

In the event of any breach of the obligations set out in this article or any other provision of these T&Cs, or in case of behaviour likely to harm the security, availability, or proper functioning of the Mini Site, ARTE GEIE reserves the right to take any appropriate measure, including restricting, suspending, or terminating the User’s access to the Mini Site, without prejudice to possible legal action.

ARTICLE 6. PERSONAL DATA PROTECTION

ARTE GEIE processes personal data relating to Users of the Mini Site, i.e., information concerning identified or identifiable natural persons, directly or indirectly.
To this end, ARTE undertakes to comply with applicable data protection laws, including Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and the amended French Data Protection Act No. 78-17 of 6 January 1978.

The processing of personal data is primarily intended to allow Users to vote on the Mini Site, to enable ARTE to organise and manage the ArteKino Festival 2025, to count the votes cast, and to ensure the security and proper operation of the Mini Site.

In accordance with applicable regulations, Users have the right to access, rectify, object to, delete, and restrict processing of their personal data; the right to withdraw consent at any time; and the right to data portability. These rights can be exercised by contacting ARTE GEIE:

  • By email: dpo-arte@arte.tv.
    Users also have the right to lodge a complaint with a supervisory authority, such as the Commission Nationale de l’Informatique et des Libertés (CNIL).

To protect your privacy, we may take reasonable steps to verify your identity before responding to your request.

ARTICLE 7. INTELLECTUAL PROPERTY

All elements making up the Mini Site – its general structure, architecture, interfaces, texts, software, animations, images, videos, sounds, logos, trademarks, graphic elements, and more generally, all other content – are protected by intellectual property rights and remain the exclusive property of ARTE GEIE and, where applicable, its licensors.
The films, excerpts, visuals, posters, trailers, and other audiovisual works distributed as part of the ArteKino Festival 2025 remain the property of their respective authors, producers, or rights holders and are made available on the Mini Site temporarily and with their authorisation.
Access to the Mini Site grants the User no intellectual property rights over these elements or the content accessible therefrom.
Any reproduction, representation, adaptation, translation, modification, extraction, reuse, or distribution, in whole or in part, of the Mini Site or its content, by any means whatsoever, without ARTE GEIE’s prior written authorisation, is strictly prohibited and constitutes an act of infringement that may give rise to legal proceedings.
Users therefore undertake not to reproduce, represent, adapt, modify, transfer, market, distribute, or imitate any part of the Mini Site or its accessible content, under penalty of civil and/or criminal sanctions.

ARTICLE 8. LIABILITY

By using the Mini Site, the User warrants that they have the necessary skills, equipment, and software to use the Mini Site and the Internet safely. They are fully aware of and accept the characteristics and limitations of the Internet, including technical performance, response times and communication security risks.
The User is solely responsible for their use of the Mini Site and for any direct or indirect, material or immaterial damage caused to ARTE GEIE and/or third parties in connection with such use.
Access to the Mini Site may be suspended, restricted, or interrupted at any time, without notice and at ARTE GEIE’s sole discretion, particularly for technical, security, maintenance, update, or legal reasons, without entitling Users to any compensation.
Except as required by mandatory legal provisions, ARTE GEIE cannot be held liable for any damage, material or immaterial, suffered by the User and/or third parties, resulting notably – but not limited to – from:

  • Access to and/or use of the Mini Site;
  • Temporary inability to access all or part of the Mini Site;
  • Malfunction, interruption, suspension, or failure of the Mini Site;
  • Security incidents, hacking, and/or fraudulent use of the Mini Site, particularly when resulting in the dissemination of illegal or misleading content;
  • Loss of data, presence of viruses, intrusion, or any unauthorised interference with information systems;
  • More generally, any damage resulting from improper use of the Mini Site and/or its functionalities by a User or third party.

ARTE GEIE shall not cover connection costs or, more generally, any communication costs arising from access to and use of the Mini Site.

ARTICLE 9. TERM AND AMENDMENT OF THE T&Cs

These T&Cs shall remain in effect for the entire duration of the Mini Site’s availability.
ARTE GEIE reserves the right to amend these T&Cs at any time, particularly to reflect legal, technical, and/or organisational developments.
Any modification to these T&Cs takes effect upon being published on the Mini Site and applies immediately to all subsequent access or use.
Users are invited to consult the most recent version of these T&Cs, available on the Mini Site, on a regular basis.

ARTICLE 10. GOVERNING LAW AND JURISDICTION

These T&Cs are governed by French law.
In the event of any discrepancy between linguistic versions, the French version of the T&Cs shall prevail.
For Users acting in a professional capacity, any dispute relating to the interpretation, performance, or validity of these T&Cs shall fall within the exclusive jurisdiction of the courts within the jurisdiction of the Colmar Court of Appeal.
