Rules of the “ArteKino – European Cinephile Award 2022” competition entries from 01.12.2022 to 31.12.2022

1 - ORGANISATION

ARTE GEIE, whose registered office is at 4 quai Chanoine Winterer, 67000 Strasbourg (hereinafter referred to as “ARTE GEIE”, and ARTE France, whose registered office is at 8 rue Marceau, 92130 Issy-Les-Moulineaux (hereinafter referred to as “ARTE France”,

hereinafter referred to together as “ARTE”,

are organising a free competition without obligation to purchase from 01/12/2022 to 31/12/2022 inclusive, called the “ArteKino – European Cinephile Award 2022” competition, in which entrants can win the prize(s) described in Article 4 of these Rules.

The competition will be published on ARTE’s website at the following address: http://artekinofestival.arte.tv/.

The competition is open to any natural person of full age and resident in Europe (including European Union countries, the United Kingdom, and European Free Trade Association countries), excluding temporary and permanent members of the staff of the organising company and their families.

For the avoidance of doubt the following terms are defined in these Rules as follows:

“Entrant”: any person who has completed and confirmed the competition’s entry form and who has voted for at least eight of the twelve films competing in the ArteKino Festival 2022;

“Winner”: any person who has been drawn at random from among the Entrants.

2 - PROCEDURE FOR TAKING PART IN THE COMPETITION

To take part in the competition, Entrants must go to the http://artekinofestival.arte.tv/ website and click on the “Vote” button appearing below the film that they wish to rate. Entrants must rate the chosen film and then enter their e-mail address.

In order to be valid, the entry form must be completed in full and include the rating for the selected film as well as the Entrant’s e-mail address.

Incomplete forms will not be entered in the draw.

The competition will take place as follows: Entrants can take part in the competition until 31/12/2022, by clicking on the “Vote” button appearing below the film that they wish to rate. In order to be included in the draw to take place on 10/01/2023, as specified in Article 3 of these Rules, Entrants must vote for at least eight of the twelve films competing in the ArteKino Festival 2022. The Winners will be contacted by e-mail after the draw has taken place, at the address used in their entries.

Entrants must take part individually and each Entrant (with the same e-mail address) can only vote once for each film.

Altering or attempting to alter the competition’s systems, and in particular in order to change the competition’s procedures or anything determining its outcome, by any means whatever, is strictly prohibited, and ARTE reserves the right to take any legal action it might consider necessary, including criminal proceedings, in the event of such interference. ARTE reserves the right, by any available means and as it sees fit, to ensure that all Entrants have an equal chance in the competition, and to disqualify any Entrant who fails to comply fully with these Rules.

ARTE is also entitled to disqualify any Entrants and/or their contributions from this competition if they act in breach of these Rules, and in particular if they breach the terms of participation in the competition. ARTE’s decision in this respect shall be final. In placing content on ARTE’s website, Entrants undertake to respect the Channel’s authority and the provisions set out above.

Communication/internet expenses incurred in viewing and taking part in the competition during the entry period will be the Entrant’s responsibility.

Entrants can take part in the competition until midnight on 31/12/2022.

3 - PRIZE DRAW / AWARD CEREMONY

Winners of the competition will be chosen by a random draw from among the persons who have correctly completed the entry form.

The draw will take place on 10/01/2023 and will be carried out by ARTE GEIE. The draw will be carried out by ARTE G.E.I.E. manually.

ARTE France will inform the Winners by e-mail no later than 15/01/2023, using the information that they provided in their entry form. Winners must confirm their wish to receive their prizes and must provide their surname, first name, date of birth and email address no later than midnight on 31/01/2023, by sending their confirmation to the following e-mail address: artekinofestival@arte.tv.

Prizes will be awarded to the Winners by e-mail and/or by post with acknowledgment of receipt requested, at the address provided by them in their confirmation e-mail.

Prizes will be definitively lost in the following circumstances, without any possibility of appeal:

If a Winner fails to confirm his/her wish to receive the prize or fails to provide the information necessary to send the prize within the time limits indicated above;

If a Winner cannot or does not wish to receive the prize;

If the contact details given by the Winner are not or are no longer valid when ARTE delivers the prize.

Entrants who have not been successful in the draw will not be contacted by ARTE.

4 - PRIZES

The competition has the following prizes:

The prize: A weekend in a European capital (Paris) for two people on the date of their choice: travel with AirFrance in business class from a European capital and two nights in a hotel. If the winner lives in France, he/she will be able to choose his/her destination in the European Union according to the AirFrance flights from Paris. This trip will be organised by the BLEU BUSINESS agency in Clermont-Ferrand.

The prize does not include any visa fees, drinks, meals, photo and video permits at the sites, cancellation guarantee, or tips.

Prizes may not be transferred or exchanged for another prize or for their cash value. They must be accepted in kind by the Winner.

ARTE reserves the right to change the prizes if circumstances so require, without the possibility of any claim being made in this regard.

5 - LIABILITY

ARTE and its employees and representatives disclaim any liability for damage occurring in connection with the acceptance of prizes.

ARTE and its agents disclaim any liability for incidents and/or accidents or their consequences suffered by Winners or that might be caused by Winners, or more generally for any incident or accident that might occur during the competition or in connection therewith.

ARTE disclaims any liability for any problem relating to the organisation of the stay, failure on the part of the service provider(s) itself.

ARTE disclaims any liability for problems relating to the failure of the service provider(s) responsible for delivering the prize, the condition of the prize, its operation or the delivery time.

In addition, ARTE reserves the right, for any reason whatever, to shorten, extend, amend or cancel the competition without prior notice, and disclaims any liability in such circumstances, including any liability to compensate the Entrants.

ARTE reminds Entrants of the characteristics and limitations of the telecommunications network and disclaims any liability for any consequences arising from Entrants connecting to that network via the website.

Furthermore, ARTE disclaims any liability for delivery problems or loss of postal or electronic mail.

6 – PERSONAL DATA PROCESSING PROCEDURES

ARTE G.E.I.E. is responsible for the organisation of the vote (registration and validation of each of the votes), for the organisation of the competition and of the draw (if applicable), and for naming the Winners. ARTE France is responsible for awarding the prizes to the Winners.

For the purposes referred to above:

ARTE G.E.I.E. will process Entrants’ e-mail addresses; and

ARTE France will process Winners’ surnames, first names and postal addresses.

Entrants’ data will be kept until the date of the draw, namely 31 January 2023.

Winners’ data will be kept by ARTE France until 31 August 2023

ARTE G.E.I.E and ARTE France will receive the data in their capacity as data controllers.

In the context of organising the vote, ARTE G.E.I.E. uses the company Pan! as its subcontractor, located at 9 Bd de la Dordogne, 67000 Strasbourg, France.

Entrants’ data will not be transferred outside the European Union.

The personal data processing referred to above takes place on the basis of the Entrants’ consent.

In accordance with the French Data Protection Law of 6 January 1978, as amended, and the European Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), Entrants have a right of access, rectification, objection, erasure and limitation of processing, as well as a right to the portability of information concerning them, which they can exercise by sending an e-mail to the Data Protection Officer (DPO) at the e-mail address dpo-arte@arte.tv or by sending a letter by post to the following address:

In order to protect Entrants’ privacy, ARTE may take reasonable steps to verify their identity before granting their request.

For identification reasons, Participants must indicate the e-mail address used when taking part in the ARTE Kino Festival vote.

At the written request of Entrants sent in paper or electronic format, ARTE will inform them at any time of the nature of their personal data that is being processed. Any data that is still required by ARTE to fulfil its obligations or to exercise its rights, or any data that it is required to keep by law, will not be deleted.

Entrants also have the right to contact the regulatory authority of their choice.

7 - ACCEPTANCE OF THE RULES

These Rules are available on ARTE’s website at the following address: « artekinofestival.arte.tv/en/reglement/ ».

Participation in the competition implies unconditional acceptance of these Rules and of any amendments thereto. Any failure to provide information or any false declaration of identity or address will result in the automatic disqualification of the Entrant concerned.

Additions or amendments to these Rules may be published during the competition, and shall be regarded as annexes to these Rules.

These Rules are subject to French law. In the event of any contradiction between the different language versions of these Rules, the French version will prevail.

Entrants waive any legal remedies.
